Terms of Purchase and Returns
1. GENERAL
1.1. The owner of the online store Lasershop.ee (hereinafter: Online Store) is Balabanlar OÜ (hereinafter: Seller).
1.2. These Terms of Purchase regulate the legal relationship between the Seller and the person making a purchase from the Online Store (hereinafter: Buyer) when buying and selling products via the Online Store.
1.3. In addition to these terms, relationships arising from the marketing of products through the Online Store are governed by the legislation of the Republic of Estonia and applicable European Union legislation.
1.4. The Seller may change these terms and the prices of products and services. Changes are published in the Online Store. The terms and prices valid at the time of placing the order are applied to the specific transaction.
1.5. The selection of products, prices and discounts in the Online Store may differ from the selection of products, prices and discounts in any retail or partner stores.
1.6. These terms apply primarily to consumers (natural persons acting outside their business or professional activities). For business customers, the right of withdrawal and some protections may be limited as permitted by law.
2. PRICE
2.1. Information about the goods (including description and main characteristics) is provided in the Online Store directly next to each product.
2.2. All prices in the Online Store are indicated in euros (EUR) and generally include value added tax (VAT) in accordance with the legislation in force in Estonia, unless explicitly stated otherwise.
2.3. The price of the product does not include the delivery fee, unless otherwise indicated in the checkout. The delivery fee depends on the Buyer’s delivery address and the chosen delivery method. The delivery cost is shown to the Buyer before confirming the order.
2.4. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the Buyer if the price of the goods in the Online Store has been displayed significantly below the normal market price due to a technical or human error. In such case, all payments received (including delivery costs relating to those goods) will be refunded to the Buyer.
3. PLACING AN ORDER
3.1. To order goods, the Buyer must add the desired products to the shopping cart. To complete the order, the Buyer fills in the required data fields and selects the appropriate delivery method.
3.2. In the shopping cart, it is possible to change product quantities and remove products from the cart until the order has been paid.
3.3. Before confirming the order, the final payable amount including all applicable fees (product price, delivery cost and any other charges) will be displayed.
3.4. By confirming the order, the Buyer confirms that:
they are at least 18 years old or have the consent of a legal representative;
they have read and agree to these Terms of Purchase and, where applicable, the Privacy Policy.
3.5. The sales contract between the Seller and the Buyer enters into force from the moment the full amount due is received in the Seller’s bank account or payment service provider’s account.
3.6. The Seller sends an order confirmation to the Buyer’s e‑mail address. If the confirmation e‑mail is not visible in the inbox, the Buyer should also check the spam/junk folder.
3.7. If the Seller cannot fulfil the order (for example, because the product is out of stock or for another justified reason), the Seller shall inform the Buyer as soon as possible and refund all payments received for the undeliverable products (including delivery costs related to those products) without undue delay, but no later than within 14 days from sending the notification.
4. PAYMENT
4.1. Purchases made in the Online Store are paid 100% in advance, except when paying in cash or by card upon pickup if such option is offered during checkout.
4.2. The Buyer can pay for the order using the payment methods offered by the Online Store, which may include for example:
Estonian bank links;
Stripe (card payments and other methods offered by Stripe);
Cash payment upon pickup (if selected and confirmed);
Card payment upon pickup (if available at the pickup location).
4.3. Payment is made in a secure environment provided by the respective bank or payment service provider. The Seller does not have access to the Buyer’s bank or card details.
4.4. If, after placing an order, the Buyer fails to pay by bank transfer or another agreed offline method within the time limit indicated on the invoice or order confirmation, the Seller has the right to consider that the Buyer has cancelled the order and may cancel the order unilaterally.
5. DELIVERY
5.1. As a rule, the Online Store delivers products to Estonia, European Union countries, and also to the United Kingdom and United States of America. The exact list of countries and delivery methods available at any given time is shown at checkout.
5.2. Within Estonia and, where available, other countries, the products are delivered in the manner selected by the Buyer in the Online Store, including for example:
Omniva parcel machines or courier;
Courier delivery to the address specified by the Buyer;
Pickup from an agreed location (if such option is provided by the Seller).
5.3. At the Buyer’s specific request and upon agreement with the Seller, it may be possible to use other parcel machines or delivery solutions not directly listed in the Online Store, provided that the Buyer covers any additional costs and the Seller confirms such option.
5.4. The Buyer bears the shipping costs, unless a free‑shipping campaign or other arrangement applies. The shipping cost is displayed next to the chosen delivery method before the order is confirmed.
5.5. The Seller generally ships the products on working days and no later than 5 working days after confirming the order, unless a different delivery time is stated in the product description or at checkout (for example, for pre‑orders or custom‑made products). In justified exceptional cases, especially for individual custom orders or international deliveries, the Seller has the right to deliver the goods within up to 21 calendar days. If it becomes apparent that delivery will take longer than indicated, the Seller will inform the Buyer as soon as reasonably possible.
5.6. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are handed over to the Buyer or to a person designated by the Buyer, or from the moment the goods are delivered to a parcel machine, pickup point or address selected by the Buyer.
5.7. If the delivered parcel or packaging is visibly damaged, the Buyer should immediately inform the courier or parcel machine provider and also notify the Seller at info@lasershop.ee as soon as possible.
6. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE
Important: many products in Lasershop.ee are personalised or made individually. For such products, the right of withdrawal is limited by law, as explained below.
6.1. General 14‑day right of withdrawal (standard products)
6.1.1. The Buyer (consumer) has the right to withdraw from the contract concluded in the Online Store within 14 calendar days without giving a reason, if the product is not made specifically to the Buyer’s personal specifications.
6.1.2. The 14‑day withdrawal period starts from the day on which the Buyer or a third party designated by the Buyer (who is not the carrier) has received the product, or:
if several products ordered in one order are delivered separately – from the day of receipt of the last product;
if a product consists of several lots or parts – from the day of receipt of the last lot or part.
6.1.3. To exercise the right of withdrawal, the Buyer must submit a clear statement of withdrawal (e.g. by e‑mail) to the Seller within 14 days. The Buyer may use a standard withdrawal form or any other unambiguous notice containing at least:
First and last name;
Contact phone number;
E‑mail address;
Postal address;
Bank account details for refund;
Order number and order date;
Date of receipt of the product;
Name of the returned product(s) and quantity.
6.1.4. The withdrawal request must be sent to info@lasershop.ee within 14 calendar days after receiving the goods. The Seller confirms receipt of the withdrawal request by sending a reply to the Buyer’s e‑mail address.
6.1.5. The Buyer must return the product(s) to the Seller within 14 calendar days from the submission of the withdrawal notice. The deadline is met if the Buyer hands over the goods to a carrier before the expiry of the 14‑day period.
6.1.6. The product being returned must be in its original condition: unused, clean, undamaged and preferably in the original packaging, with all labels and any protective elements (e.g. protective films, moisture collectors, plastic wrapping) that do not hinder normal inspection and testing.
6.1.7. The Buyer may use the goods only to the extent necessary to verify the nature, characteristics and functioning of the goods in the same way as would be allowed in a physical store. If the product has been used more than necessary for this purpose, or shows signs of use or wear, the Seller has the right to reduce the refund amount in accordance with the decrease in the value of the goods or refuse the refund if the product is completely unusable.
6.2. Personalised and custom‑made products
6.2.1. Many products sold by Lasershop.ee are personalised or custom‑made, for example with the Buyer’s name, text, logo, design, specific measurements or other individual specifications.
6.2.2. According to applicable consumer law, the Buyer does not have the right of withdrawal for contracts relating to:
goods that are manufactured according to the consumer’s specifications; or
goods that are clearly personalised.
6.2.3. Therefore, in the case of personalised or custom‑made products, the Buyer generally cannot return the product or withdraw from the contract after the order is confirmed and production has started, unless the product is defective or does not correspond to the order (for example, wrong name, wrong design, wrong product).
6.2.4. If the Seller has made an obvious error in producing a personalised product (for example, spelling error not caused by the Buyer’s own input, wrong colour, wrong material compared to the order), the Seller will correct the error, repair or replace the product, or provide another solution in agreement with the Buyer.
6.3. Exchange and return procedure
6.3.1. If the Buyer wishes to exchange a standard product (non‑custom) for another size, model or design, this is possible within 14 calendar days from receipt of the goods, provided that the product meets the conditions described above (unused, intact, etc.) and the desired replacement is in stock.
6.3.2. If the Seller cannot replace the returned product due to unavailability of the desired size, model or colour, the Seller will contact the Buyer to offer an alternative solution (e.g. another product or refund).
6.3.3. The Buyer bears the direct costs of returning the goods (return shipping), unless:
the delivered product is defective or not as ordered; or
the Seller has clearly stated that they will cover return costs (e.g. a free returns campaign).
6.3.4. The Seller is not responsible for the returned goods before they are physically received. The Buyer is recommended to keep the proof of dispatch for any returned shipment.
6.3.5. After receiving the returned goods and checking their condition, the Seller will refund to the Buyer without undue delay and no later than 14 days after receipt of the withdrawal form all amounts received from the Buyer under the contract, including standard delivery costs. If the Buyer expressly chose a delivery method more expensive than the least expensive standard delivery method offered, the Seller is not obliged to refund the additional cost.
6.3.6. The Seller has the right to delay the refund until the returned goods have been received or until the Buyer has provided proof that the goods have been sent back, whichever occurs earlier.
6.3.7. The refund will be made to the same bank account or payment method from which the payment was made, unless otherwise agreed with the Buyer.
7. RIGHT TO MAKE A CLAIM (NON‑CONFORMITY OF GOODS)
7.1. The Seller is liable for any lack of conformity of the goods which exists at the time the goods are delivered to the Buyer and that becomes apparent within two (2) years from the date of delivery to the Buyer. During the first six (6) months after delivery, any defect is presumed to have existed at the time of delivery, and it is the Seller’s responsibility to prove otherwise.
7.2. If a product is defective or does not comply with the contract, the Buyer must notify the Seller as soon as possible, but no later than 2 months after becoming aware of the defect, by sending relevant information (including a description of the defect, order number, and photos if possible) to info@lasershop.ee.
7.3. In the event of non‑conformity or defect of the product, the Buyer has the right to demand that:
the product be repaired; or
the product be replaced with a product that is in conformity with the contract and free of defects; or
if repair or replacement is impossible or disproportionate, the Buyer may demand a reduction of the price or termination of the contract and a full or partial refund.
7.4. The Buyer may request reduction of the purchase price or termination of the contract and refund of the amounts paid if:
the Seller is unable to repair or replace the product; or
repair or replacement has failed; or
the Seller has not remedied the defect within a reasonable time; or
repair or replacement would cause unreasonable inconvenience to the Buyer.
7.5. In case of return of a non‑conforming product, the Seller will refund to the Buyer the purchase price and the reasonable transportation costs related to returning the defective product to the Seller within 14 days at the latest after agreeing on the non‑conformity and receiving the product back. The Seller may withhold the refund until the product has been returned.
7.6. The Seller bears the costs related to repair or replacement of the item during the first six (6) months from delivery. During the next 1.5 years, the Seller bears such costs only if the claim is justified. The Seller does not compensate the Buyer’s costs and is not liable if:
the value of the product has decreased or it has been damaged due to the Buyer’s fault;
defects have arisen due to improper use or storage of the product, including failure to follow instructions;
the value of the product has decreased due to normal wear and tear resulting from normal use;
the Buyer cannot provide proof of purchase (invoice, order confirmation or other document from Lasershop.ee).
7.7. In case of disagreement concerning product defects or the handling of a claim, the Buyer has the right to submit a written complaint to the Seller, stating their name and contact details, the date of the complaint, a description of the defect, and the preferred solution. The Seller will respond in writing or in a form reproducible in writing within 14 calendar days. Complaints regarding the Online Store should be sent to info@lasershop.ee.
7.8. If the Buyer and the Seller cannot resolve the dispute, the Buyer (who is a consumer) has the right to turn to the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority for out‑of‑court settlement. Information and application form:
https://www.tarbijakaitseamet.ee/et/tarbijavaidluste-komisjon
7.9. The Buyer may also use the European Union Online Dispute Resolution (ODR) platform for cross‑border consumer disputes:
https://ec.europa.eu/consumers/odr/main/index.cfm
7.10. If the parties disagree with the decision of the Consumer Disputes Committee, they have the right to file a claim with the competent county court.
8. PROCESSING OF PERSONAL DATA
8.1. The controller of personal data is Balabanlar OÜ.
8.2. The processing of personal data is carried out in accordance with the legislation of the Republic of Estonia and the European Union, including the General Data Protection Regulation (GDPR).
8.3. The Seller may process, among others, the following personal data: name, telephone number, postal address, e‑mail address, and, where necessary for refunds, bank account details. The data is used only for:
processing and fulfilling orders;
communicating with the Buyer regarding the order;
delivering the goods;
handling returns, complaints and warranty claims;
fulfilling legal obligations (e.g. accounting).
8.4. For the purpose of delivering the goods, the Seller forwards the Buyer’s personal data to transport and logistics service providers (e.g. parcel machine and courier companies) only to the minimum extent necessary.
8.5. Personal data transmitted to the Seller is protected and treated as confidential. Data transmission between the Buyer and the payment service providers or banks is encrypted. The Seller does not have access to the Buyer’s bank or payment card data. The Seller does not disclose the data received in the course of providing the service to third parties, except in cases provided by law or necessary for the performance of the contract.
8.6. The Seller may send newsletters, satisfaction surveys and marketing offers to the Buyer’s e‑mail address only if the Buyer has given prior explicit consent (for example, by subscribing to a newsletter). The Buyer has the right to withdraw this consent at any time using the unsubscribe link in the e‑mail or by contacting the Seller at info@lasershop.ee.
8.7. The Buyer has the right:
to request access to their personal data and obtain information on processing;
to request rectification or deletion of data in certain cases;
to restrict processing;
to object to processing in certain cases;
to withdraw consent where processing is based on consent;
to lodge a complaint with the Estonian Data Protection Inspectorate (AKI) or with a court if they consider that their rights have been violated in the processing of personal data. Information and contacts: https://www.aki.ee.
9. APPLICABLE LAW AND JURISDICTION
9.1. These Terms of Purchase are governed by the laws of the Republic of Estonia.
9.2. Any disputes between the Buyer and the Seller shall be resolved primarily through negotiations. Failing agreement, the dispute will be settled in the competent court of the Republic of Estonia, generally the court of the Buyer’s place of residence (for consumers) or the court of the Seller’s place of establishment (for business customers), unless mandatory law provides otherwise.
